Conservatorship – A legal proceeding which appoints a competent person to manage the financial affairs of another person.

Elder Abuse – A term which is used to describe certain types of harm to an older adult, especially where there is an expectation of trust of the elder toward the “abuser”. Abuse can be physical, emotional, psychological, financial, sexual, or entail neglect of the elder’s well-being.

Estate Planning – May involve: Wills, Trusts, Power of Attorney, Living Will & Durable Power of Attorney for Health Care, Medicaid Eligibility Review, Supplemental or Special Needs Trusts, and Affirmative Life Planning.

Guardianship – A legal proceeding which appoints a competent person to manage and ensure that a person’s medical, food, clothing, transportation, and shelter needs are met.

Medicaid Eligibility – Medicaid is only available to those with limited income and resources. You may be able to preserve eligibility by placing assets and excess income in an allowable trust, such as a Miller Trust, Special Needs Trust, or Supplemental Needs Trust.

Miller Trusts – A trust specifically drafted according to state law that may allow for a person to qualify for Medicaid benefits by assigning that person’s income and assets to the Miller Trust.

Probate – The legal process of administering a decedent’s estate under state statute by resolving all claims and distributing property and assets, according to a valid will, or intestate (without a valid will).
